AILA members David Ware (Metairie, LA) and Grace Hoppin (San Francisco, CA), Chair of theDepartment of Labor (DOL) Liaison Committee, discuss the differing policies of the DOL and the Department of Homeland Security (DHS) in regards to employees paying attorney and filing fees in the H-1B process. The panel reviews relevant law, agency guidance, regulations and statutory language. In addition, they have a conversation about recent DOL decisions including Kutty, Prince George's County and Limanseto. Finally, Ware and Hoppin give guidance on prudent practice in light of recent agency actions.
