According to a conversation between Kathleen Gasparian and an adjustment of status officer at USCIS earlier this week, a processing glitch at USCIS is causing unnecessary requests for evidence (RFE’s) to issue. The adjudicators who process I-765, applications for work authorization, were incorrectly told to use applicants’ birth certificates for adjudicating the form and have been taking them from the adjustment packet. An adjustment of status officer typically doesn't have access to what the other adjudicators have done, so the adjustment officer then requests a birth certificate copy via an RFE. As a precaution against this issue we have been adding copies of applicants’ birth certificates to the adjustment of status packet in addition to the identity documents we normally submit.
